It’s all about this:Building on earlier ministerial measures aimed at counteracting sanctions by foreign states, the so-called “Anti-Foreign Sanctions Law” of the People’s Republic of China is the most recent countermeasure, which was announced on June 10, 2021 and came into force immediately. The law opens up a far-reaching legal framework that aims to retaliate against sanctions by foreign governments. In essence, the law allows the punishment of foreign persons and organizations who are directly or indirectly involved in the formulation, decision-making or implementation of foreign discriminatory restrictions against Chinese citizens and organizations. In particular, export-oriented German SMEs could get caught between the political fronts of different legislations in Germany and China.Christina Gigler gives a brief introduction to the basic concept of the law and explains the possible effects on foreign companies operating in China.
